My mother has Family based green card, which she got last year. Since then she has been out of the country once and came back on 1st march 2010. My mom wants to go back to india for an year or so, to take care of some matters.....
how do we go on for filing her extension or parole or whataver its called...so that she can stay in India for maximum time and doesnt loose her GC ?
Whats the max time duration extension is granted for ?
what are the forms i would require?
How much time does it take for its processing?
Thanks

Back in 1986, Immigration Judges denied almost 90% of all asylum requests. Now, during the past 9 months, the Judges granted 50% of asylum requests. What's more, the disparities among various Immigration Judges have narrowed somewhat. This information is contained in a new report issued by the Transactional Records Access Clearinghouse (TRAC) of the University of Syracuse. This increase in approvals tracks with another important consideration: In 1986, only a little more than half of all asylum applicants were represented by an attorney. Today, over 90% of asylum applicants have attorneys. Attorney-represented asylum seekers have their cases granted 54% of...

I called USCIS and checked about it. The officer said that she shoul dnot have applied online and made the payment. She should have sent paper application only. And that there was no need to pay any fee. He said that the amount once paid to USCIS can not be refunded back. Ridiculous.

If you want to retain your priority date your I 140 should be approved from your old employer, else you need to start from scratch again.

I have 1-485 pending (my husband is main applicant for our greencard application).
I entered US last time using Advanced parole and I was working on EAD then. What should be my
1. Manner of Entry
2. Current immigration Status
I thought it's supposed to be Parolee with 1-485 pending. But only related drop down menu I cans see is PAR:Parolee. Is that what I should select?
I tried to find this in existing thread but could not find it. I will appreciate your help with this.
Thanks a lot.

Supposed my I-485 was approved, am I legally required to go to USCIS, surrender my I-94 card and get a I-551 stamp? Could I just wait for GC to come in the mail?
The card is taking just a few days to arrive these days. Just wait for a few more days. You need the I-485 approval notice to get I-551 stamp.
But I'm sure you won't need it.

A pretty serious accusation. Phoenix Law Enforcement Association president Mark Spencer accuses the Arizona city of inflating its kidnapping numbers to bolster its claims to stimulus money. Anti-immigrant activists have been citing the bogus numbers to bolster their claim that Phoenix is the "kidnapping capital of the world" largely as a result of illegal immigration.

The Governator makes a good case for doing immigration reform this year. Go to about 6:35 in the interview with Greta Van Susteren to hear his comments on the subject.

My current H1 is valid for 8 more months and I will have 1 more year after that to finish my initial 6 years, that gives me about 1 year 8 months before I exhaust the 6 year limit.
My question is if I change jobs and an H1 transfer is requested right now....will the transferrred H1 be valid for only 8 months ? or will I get a new I797 with 20 months validity? Help if some one knowledgeable about the issue would comment

Can we work for a Charity Organization without getting paid while on H1?
The work would probably be 2 hours a month.
Thanks,
Krishna

If your question is whether you will be considered to continue in valid H-1 status after returning to the US using your AP, then the answer is yes.

Folks,
I am on my 6th year of H1B. My current H1 expires mid August 2009.
My PERM was filed in May 2008 and was approved in Dec 2008.
My I-140 is applied and pending. I work for an american consulting company.
Naturally, I dont have an EAD as yet.
Based on my PERM approval and 365 day rule, I know I can extend my current H1 for 1 year.
(planning to do this ASAP).
Here is my question:
- My current client contract will get terminated soon. If my current GC sponsoring company decides to terminate my employment (due to project non-availability), can i transfer my extended H1B to another employer?
In other words, is an extension H1 (7th year and beyond) similar to regular H1 (first 6 years) in regards to invoke the "transfer" rule between eligible employers? or is it tied to GC sponsoring employer?
- By doing so, do I abandon my GC application (i think i will, but general clarification) ?
Any advise would be greatly appreciated,
LT
