I will start working Jan/2007 as OPT. The company will apply H-1b for me after April.1st. At the same time, I also apply for phd program and I am not sure if I can get school offer. I believe I will know the result of phd application before the H-1b gets approved.
My question is:
If I get school offer, I know it is easy to cancel H-1b but how to cancel change of status? what is my status after I leave the company and before I go to school? what do I need to do to keep OPT until enrollment?

My Wife had her COS from H4-H1, and I filed my I-485 in July with my wife as secondary applicant and already got our EAD,AP. We are planning to Visit India this month and my wife wants to use her AP while travelling back to US.
1. Is it advisable or are there any issues with using AP.
2. Can she use AP that she received as a secondary applicant and continue to work on H1B with her current employer
3. In Case her Status changes to EAD, can we reinstate her H1B at any point in time without counted against H1B Cap.
Pl Advise.

My friend John Lamb in Nashville blogs today about ICE's Hutto detention center where whole families are jailed while awaiting deportation. I'm reminded of Charles Dickens' tales of debtors prisons in Victorian England where "lawbreakers" who violated British laws relating to debt were jailed right along with their spouses and children. My wife received Appt. letter for FP second time. It mentioned that first time FP didn't pass thru FBI check, se she need to come again at no cost. Is this normal and did it happen to any one? We are in Atlanta.

Hello Attorney,
I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .
Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

I'm presently on H4 in US and have got the H1B visa approval(Mostly I would get the I94 and wouldn't require stamping unless i leave USA) . Due to personal reasons I need to travel to India planning to go to India.
I would like to get the visa stamped in Tijuana before I go to India.
I have not yet started working with my employer.Infact I did not get my H1B approval papers yet nor have SSN till now.(approval of H1B is on Oct 16th 2007)
Since October has been crossed and i dont have a paystub(since my approval is late) my question is are there problem if the consulate officer asks about why i have come for stamping even before starting the job (since i have 194) and what if he asks for paystubs as iam going after october 1st.
Can anyone please help?

I had an H1 for about 3 years (2 different employers), and then was hired by an international organization. I gave up the H1 and got a G4 visa, which I still have. Over the last 3 years with a G4, my credentials have changed, and am due to get my masters degree in May 2008. If I were to move to a job requiring H1 when I get my masters, will the total number of years allowed for me to hold an H1 roll back to 6 years? I'm thinking that since the skills I had as an H1B visa holder before have changed now.

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.I also heard same thing but talking to a attorney is good than posting here..
