I left my Indian consulting company and the employer owes me $14,000 which he is now refusing to pay, he says he will deduct it as a cost of H1 and GC processing fees
When I started working for him he told me that he would take care of all these costs(of course he did not give this in writing) and not at anytime was there a verbal or written agreement that I would have to repay him these costs if I left him.

What recourse do I have now?

Primary applicant is on EAD, how much min amount primary applicant has to show on W-2s?

question related to Dependent RFE:

Please submit evidence to prove legal immigration status in the USA from Jul 01, 2003 to Jul 29, 2004(I485 Receipt Date).

As dependent I came to US on H4 in 2001 and applied for H1 and approved in Jan 2002 (approved from Jan'2002 to Feb'2004).

Then don't know lawyer applied for my H4 extension along with my spouse's H1 extension. But they sent my passport for H4 stamping (stamped from Dec 2003 to Dec 2005). ie. I have 2 statuses at the same time and also here note that during december I was working. One more thing here my lawyer applied for my H1 renewal and got extension from Feb 2004 to Dec 2006.

Which extension papers(H1 or H4 attached with I94), should the dependent need to send to show legal immigrant status for the above query?really scared situation.

Please give your valuable suggestions.

I was on H1 with my previous company but laid off last week. I have !485 AOS and EAD.

I believe I can straight away join any company (consultancy or any enterprise company) on EAD , right pls ?

if get a job offer from Comapny "A" and join them today and file AC-21 today and meanwhile say I get another job from another Company "B" after two days and join them, can I file another AC-21 without waiting to hear back from USCIS. I believe AC 21 is just informational for USCIS that I have switched the jobs.

Hi All,

My OPT expires on March 20th 2012. According to USCIS rules, I am on valid F-1 status 2 months after OPT expiration. "nonimmigrant F�1 students on post-completion OPT maintain valid F�1 status until the expiration of the OPT period and the subsequent 60-day departure preparation period".

Is it possible for me to take advantage to cap-gap after expiration of OPT as I will still be on valid status? Can I quit work for 10 days after my OPT expiration and start working again on April 1st after a employer files my H-1?

Please advise.

Just want to know my options here and here is my scenario:

I am on H1-B and my 6 years of H1B is going to complete on March so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I don't have the copy of my I-140 but I think I can get it.

Hello - I just recd. the TRANSFER NOTICE for me & my wife's 485 case stating that the case has been transferred to USCIS-NBC, PO Box 648005, Lee's Summit, MO 64064. We had filed for AOS in July 2007 and my priority date for is April 2006 (EB-2).

I would appreciate it if somebody can please shed some light on what this means for us. What are the implications for us.? Will the case be transferred to the local office.? Should i start to gather documents for a interview.

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?

Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....
