I have a feeling that some positive will come out of this meeting. It might appear that USCIS is not understanding our plight. But they are made aware of our situation by this meeting. They sure will respond to our complaints.
For all those who are upset with the House hearing, please take it easy. Please do not expect the hearing to discuss the details of each and every GC applicant's case. The objective of the hearing was to bring the folks involved in visa bulletins and GC processing, and make them all publically say and agree that Lofgren-Sensenbrenner bill will not flood the country with new people on the borders but at the same time since the federal agencies did not do their job properly, so it would make sense to recapture the visa numbers, and that's it.
I think that this objective was achieved pretty handsomely without much opposition. So everybody was on the same page, other than Ranking member King, whose job in such meetings is to oppose whatever the committee chair is proposing. Rep. King did not have much to say as Rep. Sensenbrenner has co-sponsored the bill. Noticeably, Rep. Gutierrez supported the bill, which means Hispanic Caucus may not oppose it either, hopefully. So it was all good.

1. Another reply was If we use All permitted unsed visa, Where would we be in terms of EB visa. His response was Probably china/India Second category will be clear.

Sen Lugar: Since the bill has no language yet, he would like to wait before he gives an opinion. He has previously supported immigration reform. He is continuing to meet with Sen. Schumer
Sen. Enzi: Does not support amnesty and he will let us know what his position on high skilled immigrant provisions in a week

There is no official process or filing fee. Attorneys generally represent both the employer and the employee. Because revoking the petition could harm the employee, a conflict of interest arises. Accordingly, most immigration attorneys would not want to be involved in assisting in the revocation of petitions.

If only wait times were as little as 2 yrs and 7 yrs...I might not even be fighting!!!

This is not true in most cases. The F1 might be for 2 yrs minimum + 1 year EAD + at least 2 yrs on H1B before the GC process starts. Then its 7+ years...
So overall, we are talking 10+ years to get permanant residency in a majority of cases.

If you don't want to get into the trouble of debating how many years, just say that it is unreasonable....
The best solution is to write the years you spent on F1 and H1B. You can add your additional pains also.

I think the monday deadline makes sense. See, USCIS said they are going to issue the receipting update every week. Last week's update said, 7/1/2007 for EB cases at Nebraska. How would you think it would look if, after a whole week, USCIS issues another update, with the same date. Embarrassing, Eh?
So, since they have to issue the update on Friday, they put this deadline. However, they probably realize that it's not possible for them to issue receipts of all July 2nd filers by Friday, so, they move the internal deadline to Monday. That's probably the reason they did not issue a receipting update today.

My case was wrongly put in the TR catagory for 2 years despite my efforts to get the Phili center to correct it. It was finally put into RIR in April 2007 while other cases are being approved with later PDs...... Maybe I shall wait 3 more months since they promissed to have it done this September????!!!!

Received this e-mail from Tom Davis (Virginia congressman for where I live) today (Monday, July 9, 2007). Plan to reply by tomorrow mentioning it is not about "individual redress" rather a wrong imposed by USCIS/DOS on the legal-patiently waiting-community of immigrants. Any suggestions welcome.

Well, I too had a Infopass last week to check on a Soft LUD on my I-140, I heard slightly different story, they did not say adjudicating the EB application, but Process the EB application, which I guess what they were saying is pre-adjudicating the cases, in the last few weeks with lot of cases being transferred (both EB2/EB3) to different offices, pre-adjudicating the cases makes sense....but hey, we are talking about USCIS here, we never know, whatever you heard could be true too......
One piece of information that made me happy reading your comment was "a directive from the DHS/USCIS that they want to separate the legal stuff from the illegal stuff", this is good news.....but wondering what does legal/illegal mean to USCIS anyway......and how does it help us???

We just need 20,000 active members to make a change, which is approx 10% of the total number of GC apps pending. At the most 2000 people are active.
If somebody can being in 20,000 active members to this forum, the change will happen.
I dont think all the 20,000 members need to be active every day or every week. What is that you are expecting them to be active every day. If we are not able to pull the crowd, it is not the inability of the crowd but the leadership. Crowd whether it is Indian or other is always like that. It is the effective leadership that makes the difference. For example if you take Martin Luther King, Gandhi or for that matter any leader, it is their speeches/actions that inspired people to involve in the movement not just the people came all by themselves.

My friend, "USA point of view is multinational executives can potentially create jobs", but the reality is the other way round. They are here to to make the transition happen from Onshore to Offshore. I have complete knowledge on how this EB1 thing works , as I was one of them once upon a time before taking up my current job.

The only harsh thing he said was that Indian education was awful. Everything else he said was extremely positive especially when he talked about the amazing progress India is making. I think he said that because he was saying that India is racing ahead and Indians are very successful entrepreneurs. (I am not sure).

I wish I could go to Duke University or Harvard. I could not get admission or afford it if I did.
If you are objective, can you argue that much of the 350K engineers graduated in India are not up to par. No offense to the graduates, however the schools are often just not up to par. Much of this graduation is private for profit colleges, frequently owned by a few investors or families.
US Engineering colleges are much better accredited in my view.
That said however, India being a much larger country (population wise) there are probably more than 70K good quality engineering grads. coming out of India annually.
